what would you do if in this situation….?

myself and my brother purchased a home (duplex) together about 3 years ago (we both reside in it).. in the mean time he has married, him and his wife make about 5 times what i do (i am a single mom).. we are very much upside down in the loan but not behind at all in payments (we live in florida)(neighborhood is also not the most desirable)… i want to try and get out from the house either by renting it, short sale or deed in lieu avoiding foreclosure at all costs… all him and his wife do is complain about the home yet they dont want to try and get out of it.. i have even offered him my half (quick claim deed) to just let me go on my way (so he can have it to do whatever he like, rent or what not)… re-finance is not an offer i have checked and we dont qualify.. also.. my brother in my opinion is very mentally unstable.. all he does is preach how the government is corrupt and luciferianism ??? he’s storing food and saying the world is coming to an end.. him and his wife live in this “doom and gloom” state…
what would you do if in this situation.. i feel stuck.. (i obviously should of never went in on an partnership like this with my brother)
the only reason i mention his mental issues.. is cause its miserable for me to have to live next door to such a loon.. seriously he’s on the verge of being commited to a mental ward..

sooo.. this is not fair!!!?

After waiting more than 24 hours for a response, I found out that they accepted my home purchase offer, but they made a counteroffer. For 3/2 town home in MIami Florida. asking price $139,900. I offered 128,000 plus 3% seller contribution closing cost. Now they want 130K on hand and they are asking for 133K paying 3000 seller contribution. Ok, the counter offer is not that bad.. And I am willing to accept BUT, the realtor now is telling me that she is afraid that the appraisal is going to came LOW LOW LOW. the last town home sold in the same community was for $124,700 (for a 3/2 exactly the same) then they sold 2/2′s for 110K and 100K. and that is it. The appraisal will have to look elsewhere to compare. and around the block there is same town homes (another community) that they were all foreclosures 3/2 nice condition INSIDE (community is nasty) between 96K and 110K!!! So I am afraid that the appraisal is not going to reach 133K and the seller says that can not lower the price other wise she would have to go into short sale! this is not fair! the second time it happens to me and It is sooooo hard to find a place!!!!

Want to sell our Townhouse, how do we do it in this market?

We bought a brand new Condo/Townhome in Rhode Island in 2005.
Its in a decent area, 10 min from Providence. 40 min from Newport. 50 minutes from Boston. We both lost our jobs last November and are both living on one Unemployment check. With student loans, cars, insurance, utilities, mortgage, credit cards etc… Its all getting to be way too much and we are throwing away everything we’ve saved into this black hole of debt & mortgage interest.

So, we’ve read all about both types of Short Sales, (release of lien) etc.
Foreclosure, Bankruptcy etc…..

I know there is an alternative to rent our Condo/Townhouse out but the market isn’t looking that good for renting (to cover what we’d need for bills & to move) BUT, we want OUT OF HERE! We want to either move back home to upstate NY where our families are from or way down south to FLORIDA where its warm. I don’t even care if we RENT again. I’m SICK OF IT around here. One of the highest unemployment rates and we are depressed and miserable.

So, what is there for us to do?
we had so much student loan bills on credit cards we consolidated into a second mortgage while the market was still good. So, now we have the first home mortgage and a second mortgage. These total $200K the main problem is that we are 1 of 5 condo units. The one on the end went into Foreclosure when its owner skipped the country. NICE! So, with that unit selling for $129K we are screwed!

So we’d short sale and have to get forgiveness for $70K
AAaaaaahhhhhhh……………………………
If its a release of lien, I can’t afford 70K plus all my 50K in student loans and still be left with no house.

What the heck are we supposed to do?
Just want to move…..

Any help would be great!

ps- I’ve tried talking to our Mortgage Co. (First Franklin based out of CA) they are NO HELP. and have straight out told us they won’t do anything unless we are 3 to 4 months behind on payments. Of which we aren’t. We have never missed a payment.
WHY WON’T THESE COMPANIES WORK WITH US THAT NEED HELP? I DON’T GET IT…
